These Terms and Conditions apply to all bookings, hires, deliveries, collections and related services supplied by Red Hot Skips (we, us, our) to the customer named on the booking (you, your).
By placing a booking, accepting delivery, paying a deposit, or using our trailer skip, you agree to these Terms and Conditions.
Important: These Terms are subject to any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
1. Our Services
We provide trailer skip hire and related waste collection services for residential, commercial and trade customers, subject to availability, site suitability, lawful waste contents, safe loading limits, and access conditions.
We may:
- deliver and collect the trailer skip from your nominated address;
- leave the trailer skip on site for the agreed hire period; and
- provide disposal services for accepted waste streams.
Unless we expressly agree otherwise in writing, the hire is for use only at the service address recorded in the booking.
2. Booking Acceptance
A booking is only confirmed when we accept it.
We may refuse, cancel or reschedule a booking where:
- the site is unsafe or inaccessible;
- the proposed waste is prohibited or unsuitable;
- weather, traffic, breakdowns or operational issues prevent service;
- payment requirements have not been met; or
- placing or collecting the trailer skip may cause an unreasonable safety, legal or compliance risk.
Where we cannot reasonably complete the service, we will work with you to reschedule or provide an appropriate refund or credit, subject to applicable law.
3. Hire Period
The standard hire period is the period stated in your booking confirmation.
If you need extra time, you must request an extension before the collection date. Extensions are subject to availability and may incur additional hire fees.
If the trailer skip is not available for collection at the agreed time, we may charge:
- additional daily hire fees;
- wasted trip fees;
- additional labour or access costs; and
- any direct third-party or compliance costs we incur.
4. Charges and Payment
You must pay the fees notified to you at the time of booking, including any applicable:
- hire fees;
- delivery and collection fees;
- extension fees;
- overweight charges;
- prohibited waste handling charges;
- relocation fees;
- permit-related charges (if arranged by us);
- cleaning fees; and
- repair or damage charges where applicable.
Unless otherwise agreed:
- payment is due upfront for residential bookings;
- trade or account customers must pay in accordance with agreed account terms; and
- we may require a deposit or pre-authorisation before delivery.
Quoted prices are based on the information you give us. If the actual waste type, weight, loading condition, site access, or placement requirements differ materially from what was booked, we may adjust the price accordingly.
5. Cancellations and Rescheduling
If you need to cancel or reschedule, contact us as early as possible.
Unless required otherwise by law:
- cancellations made before dispatch may receive a full or partial refund, less any non-recoverable costs;
- cancellations after dispatch may incur delivery, travel or wasted trip charges; and
- same-day rescheduling is subject to availability.
We will not charge unfair cancellation or termination fees. Any fee charged will reflect our reasonable costs actually incurred.
6. Delivery Location and Site Requirements
You are responsible for ensuring the nominated site is suitable for delivery, placement and collection.
You must ensure:
- safe and lawful access for our vehicle and staff;
- sufficient space, turning area and clearance;
- no obstructing vehicles, materials or locked gates;
- the ground is stable enough to support the combined load of the trailer skip and its contents;
- all underground services, irrigation, pits, tanks, septic systems and concealed hazards are identified to us before delivery; and
- children, pets and bystanders are kept clear during delivery and collection.
You direct us where to place the trailer skip. If you request placement on a driveway, lawn, paving, decorative surface or other private surface, you accept that some marking, indentation or damage may occur depending on the load, weather and surface condition.
Nothing in this clause excludes liability for loss caused by our negligence, wilful misconduct, or any rights you have under the Australian Consumer Law.
7. Public Land, Roads and Footpaths
Unless we expressly agree otherwise in writing, you are responsible for obtaining any approvals, permits or consents required if the trailer skip is to be placed on a road, verge, footpath, public land, common property, or property you do not own or control.
You must also comply with:
- local council requirements;
- body corporate or strata rules;
- traffic management or safety requirements; and
- any owner or occupier consent requirements.
You indemnify us for fines, penalties, towing, impoundment, removal or compliance costs arising from your failure to obtain required approvals, except to the extent caused by our own fault.
8. Permitted Waste
Only the waste types we accept may be placed in the trailer skip.
Accepted waste will depend on the service booked and may include general household waste, renovation waste, green waste, light construction waste, and other waste types we expressly approve.
If you are unsure whether something is allowed, you must ask us before loading it.
9. Prohibited and Restricted Waste
Unless we expressly agree in writing and the waste can be lawfully transported and disposed of, you must not place any of the following in the trailer skip:
- asbestos or asbestos-contaminated material;
- hazardous, regulated, toxic or dangerous waste;
- chemicals, acids, solvents, fuels, oils or liquid waste;
- paint, thinners, pesticides or pool chemicals;
- gas bottles, cylinders, fire extinguishers or explosives;
- batteries;
tyres;
- medical, clinical, biological or sanitary waste;
- food waste in quantities likely to cause odour, contamination or vermin issues;
- wet concrete, cement, plaster, paints, grout, silicone, glues and adhesives. These may be disposed of in cardboard boxes or bags and allowed to dry first, before being placed into the bin. Do not scrape off these materials onto the side of the bin, or cleaning fees will be applicable.
- hot ashes, coals, flammable materials or anything that may ignite;
- sealed drums or closed containers containing unknown contents;
- e-waste, fridges, air-conditioners or other items requiring special handling, unless pre-approved; or
- any material unlawful to transport or dispose of through the booked waste stream.
If prohibited or restricted waste is loaded:
- you must remove it immediately on request;
- we may refuse collection until the issue is rectified or may empty the contents at your nominated address;
- we may arrange safe handling, quarantine, testing, unloading, transport or disposal at your cost;
- if any of the above materials are found in the bin we reserve the right to empty the entire contents of any bin on the property where the bin was delivered,. We accept no responsibility for the contents left behind or further clean up costs, or damage to property as a result of tipping the bin; and
- we may report the matter where required by law.
10. Loading Rules
You must load the trailer skip safely.
You must not:
- fill above the top rim and the lids must be able to close;
- create an unstable, protruding or unsafe load;
- place items so they overhang the sides, front or rear;
- overload the trailer skip by weight;
- concentrate heavy materials in a way that makes the load unsafe to transport;
- light fires in or near the trailer skip; or
- tamper with wheels, couplings, jockey wheel, tailgate, lids, brakes, lights or any other equipment.
Heavy materials such as soil, concrete, bricks, pavers, tiles, sand or masonry may require a specific service type, lower fill level, or separate booking. We may refuse collection of any load that is unsafe or overweight until it is corrected.
11. Access for Collection
On the collection date, you must ensure the trailer skip is accessible and safe to collect.
We may charge additional fees where:
- access is blocked;
- the load is unsafe or non-compliant;
- the site has materially changed since delivery;
- the trailer skip must be dug out, repositioned or manually cleared; or
- we are required to make a return trip.
If we consider a collection unsafe, unlawful or likely to damage persons, property, vehicles or infrastructure, we may leave the trailer skip in place and charge additional hire fees until the issue is resolved.
12. Damage, Loss and Cleaning
You are responsible for loss or damage to the trailer skip while it is on hire to you, except to the extent caused by fair wear and tear, hidden defect, or our fault.
This includes damage caused by:
- fire;
- prohibited waste;
- impact by machinery or vehicles;
- tampering or unauthorised movement;
- theft or vandalism where reasonable site security was not maintained; or
- contamination requiring special cleaning or decontamination.
You must tell us promptly if the trailer skip is damaged, moved, stolen, unsafe, or contains prohibited waste.
13. No Unauthorised Movement or Sub-Hire
You must not:
- move the trailer skip after placement unless we authorise it;
- tow it, relocate it or transport it to another address unless expressly approved by us;
- sub-hire it; or
- allow another person to use it outside your control.
Any unauthorised movement is at your risk.
14. Customer-Towed Hires (only if we approve this service)
If we allow customer towing:
- you must hold all licences required by law;
- your vehicle must be legally rated and suitable for towing the trailer skip and expected load;
- you must use the trailer skip only in accordance with road rules and manufacturer/load limits;
- you are responsible for securing the load and ensuring lights, chains, couplings and connections are correctly fitted before travel; and
- you are responsible for fines, infringements, impoundment, tolls and towing-related incidents during the period of your control.
We may refuse handover if we are not satisfied the towing setup is safe and lawful.
15. Customer Warranties
You warrant that:
- the information you provide to us is accurate;
- you have authority to book the service for the site;
- the waste loaded matches what you told us;
- the waste is lawful to transport and dispose of as booked;
- you will not place prohibited waste in the trailer skip;
- you have disclosed known site hazards and access limitations; and
- you have obtained required permits, owner consents and approvals unless we have agreed to do so.
16. Liability and Indemnity
To the maximum extent permitted by law, we are not liable for:
- delays caused by traffic, weather, breakdown, supplier issues, access issues or events beyond our reasonable control;
- minor marking or surface impact arising from placement on surfaces you nominated, where we were not negligent; or
- indirect or consequential loss, including loss of profit, loss of business opportunity or loss of goodwill.
You are liable for, and indemnify us against, claims, loss, damage, costs, fines and expenses arising from:
- prohibited waste you load or allow to be loaded;
- breach of these Terms by you or people under your control;
- unsafe loading;
- unauthorised movement or use of the trailer skip; or
- failure to obtain required approvals,
except to the extent the loss was caused by our negligence, breach of law, or conduct for which liability cannot lawfully be excluded.
17. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy you may have under the Australian Consumer Law or any other law where it would be unlawful to do so.
Where a guarantee or condition is implied by law and cannot be excluded, our liability is limited only to the extent permitted by law.
18. Photos, Records and Verification
We may take photographs, video, notes, weight records and site records before, during and after delivery or collection for operational, safety, compliance, training, insurance and dispute-resolution purposes.
You authorise us to rely on those records as evidence of:
- delivery location;
- site conditions;
- load level;
- apparent waste type;
- access condition; and
- collection status.
19. Default and Recovery
If you fail to pay amounts owing, we may:
- suspend future services;
- recover the trailer skip;
- refer the debt for collection; and
- recover reasonable enforcement costs to the extent permitted by law.
20. Privacy
We handle personal information in accordance with our Privacy Policy.
21. Complaints and Disputes
If you have a complaint, contact us first using the contact details on your booking confirmation.
We will try to resolve complaints promptly and in good faith. If a dispute cannot be resolved informally, either party may pursue any rights or remedies available under law.
22. Governing Law
These Terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland.
